1 Acceptance of Terms

By accessing or using Vampires vs. Werewolves ("the Game", "Service") at duskmaw.com, you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you ("User", "Player") and the operators of Vampires vs. Werewolves ("we", "us", "our").

If you do not agree to these Terms in their entirety, you must immediately cease using the Service. Your continued use of the Game following any update to these Terms constitutes your acceptance of the revised Terms.

You must be at least 13 years of age to create an account and play. Players under 18 must have the consent of a parent or legal guardian. We do not knowingly collect data from children under 13.

2 Game Rules & Fair Play

Vampires vs. Werewolves is a competitive browser MMO RPG. All players are expected to participate in the spirit of fair competition. The following rules apply to all gameplay:

  • Each player may maintain one (1) active account unless explicitly authorized otherwise.
  • Combat, quests, and resource gathering must be performed by a real human player in real time, not automated tools.
  • Players must not exploit bugs, glitches, or unintended game mechanics to gain an unfair advantage. Any discovered exploits must be reported to support@duskmaw.com.
  • PvP (Player vs. Player) combat is opt-in. Harassment of other players outside legitimate game mechanics is prohibited.
  • Clan and guild activities must comply with these Terms. Clan leaders are responsible for the conduct of their members within organized events.

We reserve the right to modify game mechanics, balance statistics, event schedules, and rewards at any time without prior notice as part of ongoing game development.

3 Account Responsibility

You are solely responsible for maintaining the confidentiality of your account credentials, including your password. You must not share your account with any third party or allow others to access the Game using your credentials.

You are responsible for all activity that occurs under your account. If you believe your account has been compromised, contact us immediately at support@duskmaw.com.

  • Accounts are personal and non-transferable.
  • The sale, trade, or transfer of accounts to other users is strictly prohibited.
  • You must provide accurate and current information at registration, including a valid email address.
  • Usernames may not impersonate another person, include offensive language, or violate the rights of a third party.

We are not liable for any loss or damage arising from your failure to comply with these account security obligations.

4 Virtual Currency & Items

The Game features virtual in-game currencies and items, including but not limited to Gold and Gems. These virtual items are subject to the following terms:

Important: All virtual currencies (Gold, Gems) and in-game items are virtual, intangible goods with no real-world monetary value. They cannot be exchanged, redeemed, or refunded for real money, goods, or services under any circumstances.
  • Gold is an in-game earned currency obtained through gameplay (quests, combat, trading). It has no cash value.
  • Gems may be obtained through gameplay milestones, promotional events, or — optionally — purchased with real money via third-party payment processors (see below).
  • Virtual items and currency balances are licensed to you, not owned. We may modify, remove, or rebalance any virtual item or currency at any time.
  • Virtual items and currency are not transferable between accounts and may not be sold or traded outside the Game's official systems.
  • Unused virtual currency or items have no claim to compensation upon account termination.

4.1 Paid Purchases, Currencies & Refunds

Gem packages may be purchased in one of several supported currencies (USD, EUR, UAH, PLN; additional regional currencies may be offered over time). Prices displayed on the site already include any applicable value-added tax (VAT/IVA/ПДВ) where required by law.

Depending on your country and selected currency, your transaction is processed by one of the following providers, who are independent controllers for the payment data you supply to them:

  • Stripe Payments Europe, Ltd. — default provider for USD, EUR, PLN. Accepts card, Apple Pay, Google Pay, BLIK (PL), Przelewy24 (PL), SEPA, Bancontact, iDEAL.
  • WayForPay LLC — provider for UAH transactions. Accepts card, Приват24, Monobank, Apple Pay, Google Pay.
  • Pagar.me / MercadoPago — providers for BRL and LatAm currencies (MXN, ARS, COP, CLP). Accepts local methods: PIX, Boleto (BR), OXXO (MX), PSE (CO), Webpay (CL).

Refund policy. Because Gems are a digital virtual good delivered immediately upon successful payment, we generally do not offer refunds once Gems have been credited to your account. Exceptions:

  • Duplicate charge / technical failure: If you were charged but Gems were not credited, contact support with the transaction ID within 30 days and we will credit the Gems or issue a refund through the original payment method.
  • EU/EEA consumer rights: Under Directive 2011/83/EU (Consumer Rights), digital content delivered immediately is exempt from the 14-day right of withdrawal when you have given prior express consent. Starting a Gem purchase constitutes such consent and waiver of the withdrawal right.
  • Chargebacks: Initiating a chargeback without first contacting support may result in suspension of your account pending investigation.

Purchases are for personal, non-commercial use. Reselling Gems or purchased cosmetics outside official Game systems is prohibited and may result in account termination without refund.

5 Prohibited Conduct

The following actions are strictly prohibited and may result in immediate account suspension or permanent ban without notice:

Violation of these rules undermines the experience of all players. We actively monitor gameplay data and investigate reported violations.
  • Cheating & Hacking: Using unauthorized software, scripts, memory editors, packet manipulation, or any method to alter the game client or server in an unauthorized manner.
  • Bots & Automation: Using automated programs, macros, or bots to perform actions in-game that are intended to be performed by a human player.
  • Exploiting: Intentionally exploiting known or unknown bugs, glitches, or design flaws to gain in-game advantages, items, or currency beyond intended gameplay.
  • Multi-accounting: Operating more than one account simultaneously or using alternate accounts to gain advantages over other players.
  • Real-Money Trading (RMT): Buying, selling, or trading in-game currency, items, or accounts for real money outside official channels.
  • Harassment: Threatening, bullying, stalking, or harassing other players within the Game or via in-game communications.
  • Hate Speech: Using language that is racist, sexist, homophobic, or otherwise discriminatory in usernames, chat, or other player-facing features.
  • Impersonation: Impersonating game staff, moderators, or other players.

We reserve the right to investigate suspected violations and take any action we deem appropriate, including adjusting account statistics, removing items, suspending, or permanently banning accounts.

6 User Content

"User Content" means any text, messages, usernames, clan names, or other content you submit through the Game, including in-game chat, public messages, and forum posts.

By submitting User Content, you grant us a non-exclusive, royalty-free, perpetual, worldwide license to use, display, moderate, and remove such content as needed to operate the Service.

  • User Content must not be unlawful, obscene, defamatory, threatening, or infringing upon a third party's rights.
  • You retain ownership of original content you create, subject to the license granted above.
  • We are not responsible for User Content posted by other players, but we reserve the right to remove any content that violates these Terms or is otherwise objectionable.
  • Chat messages may be logged for moderation and security purposes. See our Privacy Policy for details.

We do not endorse User Content and cannot guarantee the accuracy, integrity, or quality of any User Content visible in the Game.

7 Termination

We reserve the right to suspend or terminate your access to the Game at any time, with or without notice, for any reason including but not limited to:

  • Violation of these Terms of Service.
  • Inactivity for an extended period (accounts inactive for over 12 months may be subject to deletion following notice to the registered email).
  • Closure or discontinuation of the Service.
  • Legal obligation or court order.

You may terminate your account at any time by contacting support@duskmaw.com with a deletion request. Upon deletion, your character data, virtual currency, and gameplay history will be permanently erased in accordance with our Privacy Policy.

Termination of your account does not entitle you to any refund, compensation, or access to account data, except as required by applicable law (including GDPR data portability rights).

8 Disclaimers & Limitation of Liability

The Game is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or uninterrupted access.

  • We do not warrant that the Service will be error-free, uninterrupted, or free of harmful components.
  • Game data including character progress, items, and standings may be lost due to technical failures. We make reasonable efforts to maintain backups but cannot guarantee data integrity in all circumstances.
  • Scheduled or emergency maintenance may cause temporary unavailability of the Service.

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising out of or related to your use of the Service, including but not limited to loss of game progress, virtual items, or account access.

Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you have paid us in the twelve (12) months prior to the claim, or EUR 50, whichever is greater.

Some jurisdictions do not allow exclusion of implied warranties or limitation of liability, so certain portions of this section may not apply to you.

9 GDPR & Privacy

We are committed to protecting your personal data in accordance with the General Data Protection Regulation (GDPR) and applicable data protection laws.

Our full Privacy Policy is available at duskmaw.com/legal/privacy.html and governs how we collect, use, store, and process your personal data. Key points include:

  • We collect only the data necessary to operate the Game: email address, username, IP address, and gameplay data.
  • Data is processed on the legal basis of contractual necessity (Art. 6(1)(b) GDPR) and legitimate interest.
  • You have the right to access, correct, delete, and export your personal data at any time.
  • We do not sell your personal data to third parties.

10 Changes to Terms

We reserve the right to modify these Terms of Service at any time. When we make material changes, we will notify you by:

  • Updating the "Last Updated" date at the top of this page.
  • Displaying an in-game notice upon your next login.
  • Sending a notification to your registered email address for significant changes.

Your continued use of the Game after changes are posted constitutes your acceptance of the revised Terms. If you disagree with any changes, your sole remedy is to stop using the Service and delete your account.
